Cities under siege (I)

This is the first of a two-part post, in which I return (at last!) to a promissory note I issued last year about siege warfare in Syria.  My return is prompted by a series of reports about the catastrophic situation in Eastern Ghouta (a suburb of Damascus) and Idlib.

First, Eastern Ghouta, which has been under siege by the Syrian Arab Army and its allies since April 2013.  Most of Eastern Ghoutta was designated as one of four ‘de-escalation zones’ (see map above) under an agreement reached in May 2017, in which aerial violence and all other hostilities would be suspended for six months and humanitarian aid would be allowed across the siege lines.

But the agreement turned out to be primarily a way of killing time.  Aron Lund writes:

In September, just as the Eastern Ghouta’s de-escalation zone was finalized, the situation abruptly worsened. After ordering a halt to the already heavily restricted commercial traffic through the Wafideen crossing [see map below: more here and here], the Syrian government refused to permit any more UN aid missions.

It was a transparent attempt to stoke the humanitarian emergency in Eastern Ghouta, but this time the effect was more severe than during previous rounds of food cuts. With the rebel trading tunnels out of commission for half a year, smuggling could no longer compensate for the shortfall or bring in medicine or basic necessities like fuel, which has not entered the Ghouta since February.

Food stockpiles dwindled quickly and triggered a scramble for whatever remained available on the market, the panicky mood inflamed by suspicions that rebel-connected businessmen were hoarding goods for speculation purposes. From August to October, the already high prices inside Eastern Ghouta increased fivefold, far beyond any other region of Syria.

Air strikes (above) and artillery bombardment resumed in November and have continued, and urgent medical evacuations were denied.  Here is UN Senior Adviser Jan Egelan in December 2017:

Six months ago a very detailed evacuation plan was delivered to the government for needy cases of evacuation, on medical grounds from eastern Ghouta.  Since then, names have been added regularly and it is now, we now have a revised list of 494 names. There are among them 282 cases that need] specialized surgery, specialized treatment, specialized investigations that [they] cannot get inside. There are 73 severe cancer cases, 25 kidney failure cases and 97 heart disease cases [that are] very concerning, five acutely malnourished children that need to be evacuated, six acute mental health cases etc.

The list had to be revised because 12 patients had died while waiting for ‘a half an hour drive to hospitals in Damascus and elsewhere that stand ready to help and save lives.’  Egelan explained that ‘231 of the cases are female, 137 are children, 61 are over 65 years old.  So these are civilians, in the midst of this horrific war.’

He added:  ‘Civilians, children, no one can be a bargaining chip in some kind of tug of war, where many things are negotiated at the same time. These have a right to be evacuated and we have an obligation to evacuate them.’

Siege warfare involves not only closure of movement across the lines for those inside; it also involves opening the zone to violence from the outside.  The assault on Eastern Ghouta has provided ample evidence, but the second case is even more instructive.

And so, second, what was supposed to be the ‘de-escalation’ zone of Idlib has been converted into a ‘kill box’ (for a discussion of the term in relation to remote warfare, see here and here).  Here is Martin Chulov and Kareem Shaheen writing in the Guardian:

Russian and Syrian jets bombed towns and villages across north-west Syria on Monday, devastating civilian areas and forcing fresh waves of refugees to flee to open ground in the biggest aerial blitz on opposition-held areas since the fall of Aleppo more than a year ago.  Monitoring groups said as many as 150 airstrikes were recorded in Idlib province by Monday, with dozens more pounding up to 18 towns across the region by nightfall.  Residential areas bore the brunt of the strikes, which severely damaged at least two major hospitals, and levelled dozens of buildings in which panicked locals had taken shelter.

Refugees and locals say they fear that Idlib has been transformed into a kill box, with the international community paying scant regard to their fate, as regional powers, Russia, Turkey and Iran all vie for influence in a vital corner of the country.

These strikes were in retaliation for the downing of a Russian aircraft – in this spectacularly asymmetric war, only air-to-ground attacks are acceptable – but aerial violence against civilian infrastructure in Idlib precedes that incident.  Owdai (al Hisan) hospital in Saraqab City was hit by air strikes on 21 and 29 January, for example, and has now closed indefinitely  MSF reports that the loss of the hospital is all the more devastating because ‘medical needs in the area are expected to increase due to the massive displacement of Syrians fleeing fresh violence in Idlib’s eastern countryside and northeast Hama.’

Since then, the strikes intensified:

“The Russians are on a frenzy. They’re going mad. The shelling is ongoing throughout the day and night. The warplanes are hitting residential areas,” Hadi Abdullah, a local journalist, told Al Jazeera by phone from the town of Kafr Nabl in the northwestern Syrian province bordering Turkey…

The main hospital in Maaret al-Numan [above: this was the largest hospital in Idlib], east of Kafr Nabl, has stopped working after it was hit by air strikes, according to the civil defence – also known as the White Helmets.  “About 10 air raids hit the hospital. It was a disaster,” said Hadi, who had rushed to the scene.”The most difficult and heartbreaking scene was when the volunteers were quickly pulling the babies out of the hospital. I can’t get the image out of my head,” he recalled with a trembling voice.

‘De-escalation’ has become a prelude to its inverse.  “There is a misperception that the de-escalation areas have resulted in peace and stability,’ UN assistant secretary-general Panos Moumtsiz said today. “If anything, these have been serious escalation areas.”

I plan to approach the issue through one of my favourite books, Steve Graham‘s Cities under siege.  Steve’s object was what he called ‘the new military urbanism’ but the situation in Syria – and elsewhere: think Mosul in Iraq (see, for example, here: scroll down) or Israel’s endless sieges of Gaza (see, for example, here) – demonstrate the extraordinary capacity of later modern war to combine cutting-edge technology (never has that adjective been more dismally appropriate) with medieval cruelty.  There is another difference; for all Steve’s analytical passion – and empathy – the voices of those inside the cities under siege are largely silent, yet in Syria (again: and elsewhere) digital media allow us to listen to them and to witness their suffering.  More soon.

Taking it to the limit

A postscript to my posts here, here and here on civilian deaths from air strikes in Iraq, Syria and elsewhere: Vice has an extended interview with Chris Woods of Airwars here.

The biggest issue we saw in 2017—particularly if we look at the US-led coalition—was that the war moved very heavily into cities. That, more than any other single factor, resulted in the deaths of many more civilians and casualty events. We saw a similar pattern at the back end of 2016, when Russia and the Assad regime heavily bombed east Aleppo. There’s a very strong correlation between attacks on cities and large numbers of civilian casualties. And frankly, it doesn’t matter who’s carrying out those attacks. The outcome for civilians is always dire…

Things didn’t get any better under Trump for civilians—in fact, they got a lot worse. One of the reasons for that was the intensity of the bombardment. We saw an absolutely ferocious bombing campaign by the US and its allies in both Mosul and Raqqa in 2017. Between those two cities, the coalition alone dropped 50,000 munitions. One bomb or missile was dropped on Raqqa every 12 minutes, on average, for the duration of the four-month battle…

When Russia and the Assad regime were bombing Aleppo in late 2016, we had assumed that a key reason for the large number of civilian casualties was down to the fact they were primarily using dumb-bombs. We have actually changed our modeling since then, based on what we have seen with the coalition in places like Raqqa and Mosul. The reason is that even when you use precision bombs on cities, really, the outcome for civilians is the same as a dumb bomb. You can’t control what the bombs do when they land.

We saw very little difference between Russian and coalition strikes when it came to bombing cities. This is the big problem we have with a shift to urban warfare —it’s really taking us to the limits of any benefits we might have in terms of protecting civilians by using precision munitions.

Chris also has some characteristically smart (and sharp) things to say about transparency and accountability too…

Killing cities

In a perceptive commentary on the ground-breaking investigation by Azmat Khan and Anand Gopal into civilian casualties caused by the US air campaign against Islamic State (Daesh) in Iraq – see also my posts here and hereRobert Malley and Stephen Pomper write:

The Trump administration has celebrated a no-holds-barred approach to the fight against ISIS, given greater deference to ground commanders, loosened restrictions imposed by its predecessor, and expanded the fight to an ever-growing number of Middle Eastern and African theaters. This adds up to a quasi-automatic recipe for greater civilian casualties. Independent monitoring organizations have tracked the numbers, and invariably they point to a serious uptick in civilian deaths in Iraq and Syria since January 2017. The explanation lies partly in the transition in Iraq and Syria toward the final, more urban phase of the conflict in the heavily populated cities of Mosul and Raqqa. But partly only. It also lies in policy guidance, as well as in matters such as tone, attitude, and priorities set at the very top—including by the commander in chief. These have a way of trickling down and affecting performance on the battlefield.

And yet. Those dead civilians that The New York Times found not to have been counted were not counted by the Obama administration. They were not counted by people who were intent on limiting civilian casualties and ensuring transparency. That those safeguards proved inadequate even in the hands of an administration that considered them a priority raises particularly vexing questions.

Part of the problem, as they note, is the nature of the campaign itself.  This is not the sort of counterinsurgency campaign that emerged in Afghanistan and Iraq in which air power was used in support of US and allied ground troops (although we know that also produced more than its share of civilian casualties); neither is it a counterterrorism campaign directed against so-called High Value Targets who supposedly ‘present a direct and imminent threat to the United States’ (ditto; and as I discuss in ‘Dirty dancing’ – DOWNLOADS tab – ‘imminence’ turned out to be remarkably elastic, a deadly process of time-space expansion).
Ultimately, though, their anxieties turn on what they call the ‘over-militarization’ of the US response to al Qaeda and its affiliates and to IS.  They explain, succinctly, what has encouraged this militarized response (not least the lowering of the threshold for military violence allowed by remote operations):
[U]ntil this changes, an increasing number of innocent lives will suffer the consequence. Some will be counted. Others, not. All will have paid a terrible price.
In December the Bureau of Investigative Journalism confirmed an escalation in US air strikes across multiple theatres in Trump’s first year in office:
President Donald Trump inherited the framework allowing US aircraft to hit suspected terrorists outside of declared battlefields from his predecessor, Barack Obama. Bar some tinkering, his administration has largely stuck within the framework set by the previous one.

However, the quantity of operations has shot up under President Trump. Strikes doubled in Somalia and tripled in Yemen [in 2017].

In Afghanistan, where the Bureau has been monitoring US airstrikes since it was officially declared a noncombat mission at the end of 2014, the number of weapons dropped is now approaching levels last seen during the 2009-2012 surge.

Meanwhile, there are signs that the drone war may be returning to Pakistan, where attacks were also up, compared with 2016.

Much remains unclear about these actions, apart from Trump’s signature combination of machismo and ignorance, but we do know that Obama’s restrictions on the use of military force outside Afghanistan, Iraq and Syria have been loosened:

In 2013, Obama introduced measures that meant that strikes in areas of countries that were not active war-zones, such as Pakistan and Yemen, had to go through an elaborate sign-off process with the White House.

The Trump administration effectively side-stepped the restrictions by declaring parts of Somalia and Yemen to be areas of “active hostilities”.

In September NBC reported that the Trump administration was planning to allow the CIA to take a more aggressive role and to give the agency more authority to conduct (para)military operations.  In consequence a comprehensive revision of Obama’s guidelines was in prospect:

The drone playbook, known as the Presidential Policy Guidance, or PPG, includes a provision that no strike should go forward unless analysts determine that there is a near-certainty that no civilians will be harmed. And it includes a provision forbidding the addition of new detainees to the U.S. prison in Guantanamo Bay, Cuba.  The Trump administration is contemplating removing both of those restrictions.

Pakistan remains a nominally covert area of operations.  US drone strikes in the Federally Administered Tribal Areas resumed in March after a nine-month hiatus – though Trump’s latest spat with Islamabad raises questions about the sporadic but systematic co-operation that had characterised so much of the campaign – and (provocatively: again, see ‘Dirty Dancing’ for an explanation) one strike took place outside the FATA in June 2017.  The Bureau’s detailed list is here: five strikes are listed, killing 15-22 people.

In Afghanistan the Bureau noted that air strikes had doubled and that this escalation has been accompanied by a corresponding decrease in transparency (Chris Woods told me the same story for Iraq and Syria when we met in Utrecht).

All of this confirms the report released today by Action on Armed Violence.

At least 15,399 civilians were killed in the first 11 months of 2017 according to Action on Armed Violence’s (AOAV) recording of English language media explosive violence events.  This devastating toll – up to the end of November – strongly suggests that 2017 was the worst year for civilian deathsfrom explosive weapons since AOAV’s records began in 2011.

This sharp rise, constituting a 42% increase from the same period in 2016, when 10,877 civilians were killed, is largely down to a massive increase in deadly airstrikes.

Compared to 2011, the first year of AOAV’s recording, the rise in civilians killed by explosive violence in the first 11 months of 2017 constitutes an 175% increase (5,597 died in the same period seven years ago).

On average, our records to November show that there were 42 civilian deaths per day caused by explosive violence in 2017.

The report continues:

For the first time since our recording of all English language media reports of explosive weapon attacks began, the majority of civilian deaths were by air-launched weapons. Of the total civilian deaths recorded (15,399), 58% were caused by airstrikes, mainly in Syria, Iraq and Yemen.

Civilian deaths from airstrikes in this 11-month period was 8,932 – an increase of 82% compared to the same period in 2016 when 4,902 civilians were killed, or 1,169% compared to 2011, when 704 died.

Significantly, as airstrikes are almost always used by State actors, rather than non-State groups, States were responsible for the majority of civilian deaths from explosive weapons for the first time since our records began.

Iain Overton, Executive Director of AOAV commented:

 These are stark figures that expose the lie that precision-guided missiles as used by State airforces do not lead to massive civilian harm. When explosive weapons are used in towns and cities, the results are inevitable: innocent children, women and men will die.

In the same vein, Karen McVeigh‘s summary for the Guardian quotes Chris Woods from Airwars:

This is about urban warfare and that’s why we are getting crazy numbers… War is moving into cities. It doesn’t matter whether it’s Russia or the US-led coalition or ground forces leading the assault, the outcome for civilians under attack is always dire…. We’re becoming too complacent about urban warfare, and militaries and governments are downplaying the effects.

I think that’s right, though I also think war is moving back into the cities (if it ever left them); the serial military operations in Mosul and Raqqa are vivid examples of what Chris means, but they also recall the assaults on Fallujah and other cities documented in Steve Graham‘s still utterly indispensable Cities under siege.

The point is sharpened even further if we widen the angle of vision to take in air campaigns conducted by other air forces: the Syrian Arab Air Force and the Russian Air Force in Syria, or the Saudi-led coalition in Yemen.

Yet again, killing cities to save them.  As a spokesperson for Raqqa is Being Slaughtered Silently put it last summer, ‘This is very similar to the Vietnam war, where entire cities were destroyed… What is happening in Raqqa is like dropping a nuclear bomb in stages.’

Steve’s work should also remind us that these dead cities are not produced by air strikes alone.  Once reduced to rubble they have often been disembowelled (I can think of no better word) by ground forces; it’s as though these now barely human landscapes compel or at any rate license the continued degradation of both the living and the dead:  see, for example, Kenneth Rosen on ‘The Devil’s Henchmen’ here or  Ghaith Abdul-Ahad‘s chillingly detailed report on the aftermath of the liberation of Mosul here.

I’m still astonished that all those high-minded theoretical debates on planetary urbanism somehow ignore the contemporary intensification of urbicide and urban warfare (see ‘Mumford and sons’ here).

Seeing Civilians (or not)

Very welcome news from Christiane Wilke that her essay, ‘Seeing and Unmaking Civilians in Afghanistan: Visual Technologies and Contested Professional Visions‘, has just been published in Science, Technology and Human Values.

It’s an original, compelling and immensely important analysis of a US air strike on two tankers hijacked by the Taliban and beached on a river crossing near Kunduz (Afghanistan) in September 2009.  The strike was called in by a Bundeswehr officer who claimed – falsely – that he was facing what the military call ‘troops in contact’ which required immediate action; the two American pilots of the F-15s repeatedly questioned his decision but to no avail, and when the smoke cleared somewhere between 26 and 147 civilians who had been siphoning petrol from the stranded tankers had been killed.

I published a preliminary analysis of the attack, ‘Seeing like a military‘, and subsequently heard Christiane give an early version of her own argument at a conference in Lancaster in May 2014; we’ve had a lively dialogue about the strike since then.  Here is the abstract:

While the distinction between civilians and combatants is fundamental to international law, it is contested and complicated in practice. How do North Atlantic Treaty Organization (NATO) officers see civilians in Afghanistan? Focusing on 2009 air strike in Kunduz, this article argues that the professional vision of NATO officers relies not only on recent military technologies that allow for aerial surveillance, thermal imaging, and precise targeting but also on the assumptions, vocabularies, modes of attention, and hierarchies of knowledges that the officers bring to the interpretation of aerial surveillance images. Professional vision is socially situated and fre- quently contested with communities of practice. In the case of the Kunduz air strike, the aerial vantage point and the military visual technologies cannot fully determine what would be seen. Instead, the officers’ assumptions about Afghanistan, threats, and the gender of the civilian inform the vocabulary they use for coding people and places as civilian or noncivilian. Civilians are not simply “found,” they are produced through specific forms of professional vision.

And here is her key conclusion which clearly resonates far beyond Kunduz (see, for example, here and here; I’ve radically reworked the presentation from which those two posts derive, and you can get some sense of where I’m heading here):

In Afghanistan and in situations of armed conflict more generally, the distinction between civilians and noncivilians is a crucial dimension of seeing, intervening in, and responding to violence. The protection of civi- lians is an almost universally proclaimed goal; it is the centerpiece of the ISAF 2009 Tactical Directive. Yet without a reliable understanding of who counts as a civilian and how they can be recognized, the promise of civilian protection rings hollow. The category of the civilian, derived from specific Eurocentric understandings of armed conflict, had been grafted onto Afgha- nistan and Afghans who had to negotiate their security amidst conflict. Yet it is not clear what Afghans should do or avoid in order to be recognized as civilians. Those who shared the aerial viewpoint could not agree on the civilian status of the people near the trucks and neither could those who had extensive personal knowledge of the local social structures. Thus, a shift in perspective did not solve the problem that civilians are not clearly recogniz- able to those who have a mission to spare and protect them. At a deeper level, the lack of consensus about visually identifying civilians indicates a lack of agreement about who counts as a civilian. NATO officers consistently try to stabilize and shrink the category of civilian by juxtaposing it with a capacious category of noncivilians: insurgents, militants, supporters, and Taliban…

Yet civilians don’t simply exist. They are enacted and produced by, among other sites, socially situated interpretation of images produced with the aid of visual technologies. Sociocultural prisms of visibility not only produce counts of legitimate civilians but also legitimize the category of civilian as a workable and meaningful foundation of international law. The people who would like to be regarded as civilians bear the burden of distinguishing themselves from putative noncivilians according to criteria that they can never fully grasp because they don’t know which background knowledges and epistemes will be mobilized by those in charge of distinguishing civilians from combatants.

And – please note – this is not about drone strikes; not only have the vast majority of strikes in Afghanistan been carried out by conventional strike aircraft (why do so many of those who campaign against drones ignore other forms of aerial violence?) but no drones were involved in this particular attack either; the sharp point that Christiane makes applies to all airstrikes – and indeed, to militarised vision more generally.

Bombing lists

It’s the time of year for endless – and often unimportant or uninformative – statistics to be released.  But this one is important, even if its meaning is less than clear.  Micah Zenko has published this tabulation showing the geographical distribution of bombing by the US Air Force in 2016 (from all platforms, including remotely piloted aircraft):

The problem comes in knowing how the figures (‘numbers of bombs dropped’) have been derived, since the Air Force reports numbers of ‘strikes’ not munitions dropped.  Here is US Central Command:

A strike, as defined in the CJTF [Combined Joint Task Force for Operation Inherent Resolve] releases, means one or more kinetic events that occur in roughly the same geographic location to produce a single, sometimes cumulative effect for that location.

So having a single aircraft deliver a single weapon against a lone ISIL vehicle is one strike, but so is multiple aircraft delivering dozens of weapons against a group of buildings and vehicles and weapon systems in a compound, for example, having the cumulative effect of making that facility (or facilities) harder or impossible to use.

Accordingly, CJTF-OIR does not report the number or type of aircraft employed in a strike, the number of munitions dropped in each strike, or the number of individual munition impact points against a target.

Air strikes in Iraq and Syria to 17 May 2015

I’ve taken the maps above from the BBC, which rely on reports from the Institute for the Study of War and news releases from US Central Command on ‘Operation Inherent Resolve‘.

For readers wanting to follow and analyse the US-led air campaign in Iraq and Syria in more detail, I recommend Chris Woods‘ new project, Airwars.  Chris is a veteran of the Bureau of Investigative Journalism’s Drone War Project and the author of Sudden Justice: America’s secret drone wars (2015) – which really is the gold standard for analysis of US remote operations.

Airwars.org is a collaborative, not-for-profit transparency project aimed both at tracking and archiving the international air war against Islamic State (Daesh), in both Iraq and Syria. We also seek to highlight – and follow up where possible – those cases in which claims of civilian non-combatant casualties from coalition airstrikes have been indicated by credible monitoring agencies. In addition we track reported ‘friendly fire’ incidents.

AIRWARS 25 May 2015

I’m tracking all this for The everywhere war…  In case you are wondering why that is taking so long to finish: The colonial present started out as an essay on 9/11 and the US invasion of Afghanistan; I then realised that Sharon was taking advantage of the ‘war on terror’ to ramp up Israeli dispossession and repression of the Palestinian people, and so started work on a second essay (I’m ashamed to say that at the time I knew as little about the West Bank and Gaza as I did about Afghanistan on 11 September 2001).  Then the US invaded Iraq…  Much the same is happening with The everywhere war, but I do have the end in my sights.  I hope.

 

Playing a blinder

A characteristically smart post from Larry Lewis at War on the Rocks about Obama’s promise to investigate the mistakes made in the CIA-directed drone strike that unwittingly killed two hostages in Pakistan in January 2015.  ‘We’ve been on that path before, in Afghanistan,’ he writes, ‘and we know where it leads: more promises followed by a repeat of similar mistakes.’

Larry explains that the US military was causing an ‘unacceptable number’ of civilian casualties in Afghanistan between 2006 and 2009:

JCCSWhen an incident occurred, they investigated the incident, made changes to guidance, and promised to keep such an incident from happening again. But these incidents kept happening. So the military repeated this ineffective review process again and again. This “repeat” cycle was only broken when military leaders approved the Joint Civilian Casualty Study, a classified outside review requested by General Petraeus. This effort had two key differences from earlier efforts. First, it was independent, so it was able to overcome false assumptions held by operating forces that contributed to their challenges. And second, the study looked at all potential civilian casualty incidents over a period of years, not just the latest incident. This approach helped identify systemic issues with current tactics and policies as the analysis examined the forest and not just the nearest tree. This study also considered different sets of forces operating within Afghanistan and their relative propensity for causing civilian casualties.

The first is that it is a mistake to abstract strikes carried out by a Predator or a Reaper from air strikes carried out from conventional platforms; the latter are often facilitated and even orchestrated by a UAV – as in the ‘signature’ case of the Uruzgan strike in 2010 – but, pace some drone activists, our central concern should surely be the wider matrix of military violence.  This also implies the need to articulate any critique of CIA-directed drone strikes in Pakistan with the use of air power in Afghanistan (and not only because USAF pilots fly the ‘covert’ missions across the border).  Here General Stanley McChrystal‘s Tactical Directive issued in July 2009 that directly addressed civilian casualties is a crucial divide.   As Chris Woods emphasizes in Sudden Justice,

‘Radically different tactics were now being pursued on either side of the “AfPak” border…. Even as Stanley McChrystal was cutting back on airstrikes in Afghanistan, the CIA was escalating its secret air war in Pakistan’s tribal areas.’

The second issue is the extraordinary partitions – blinkers might be more accurate – that seem to be imposed on military operations and investigations.  In the case of the Uruzgan attack, for example, a military lawyer was called in at the eleventh hour to monitor the video feeds from the Predator as it tracked a ‘convoy’ (a term surely as leading as ‘Military-Aged Male’) in the early morning.  As the next two slides show, taken from my ‘Angry Eyes’ presentation, the JAG knew the Rules of Engagement (ROE) and the Tactical Directive; he obviously also knew the legal requirements of proportionality,  distinction and the rest.

Knowing the ROE, the Tactical Directive and the formal obligations of international law is one thing (or several things): but what about ‘case law’, so to speak?  What about knowledge of other, similar incidents that could have informed and even accelerated the decision-making process?  In this case, before the alternative course of action could be put into effect and an ‘Aerial Vehicle Interdiction’ set in motion – using helicopters to halt the three vehicles and determine what they were up to – two attack helicopters struck the wholly innocent ‘convoy’ and killed 15-21 civilians.  Fast forward to the subsequent, I think forensic Army investigation.  This is the most detailed accounting of a ‘CIVCAS’ incident I have read (and you’ll be able to read my analysis of it shortly), and yet here too – even with senior military legal advisers and other ‘subject experts’ on the investigating team – there appears to be no reference to other, similar incidents that could have revealed more of the ‘systemic issues’ to which Larry so cogently refers.

This is made all the stranger because there is no doubt – to me, anyway – that the US military takes the issue of civilian casualties far more seriously than many of its critics allow.

Civil(ian) wars in Yemen

It’s not easy to keep track of the intensifying civil war/proxy war in Yemen, but the New York Times has published a series of maps – including the one below – that sketch out some of the contours of violence.

Not surprisingly, the Saudi-led air strikes (‘Operation Decisive Storm’ – really) have been ineffective in halting the advance of the Houthis; in fact, they may be counterproductive.  Three days ago senior United Nations officials warned that the loss of civilian lives and the repeated attacks on civilian infrastructure may constitute grave violations of international law, and there are now reports that US officials are also becoming alarmed at the mounting toll of civilian casualties.

The United States is, of course, intimately involved in the air campaign.  According to the Los Angeles Times:

Pentagon officials, who pride themselves on the care they take to avoid civilian casualties, have watched with growing alarm as Saudi airstrikes have hit what the U.N. this week called “dozens of public buildings,” including hospitals, schools, residential areas and mosques. The U.N. said at least 364 civilians have been killed in the campaign.

Although U.S. personnel don’t pick the bombing targets, Americans are working beside Saudi military officials to check the accuracy of target lists in a joint operations center in Riyadh, defense officials said. The Pentagon has expedited delivery of GPS-guided “smart” bomb kits to the Saudi air force to replenish supplies.

The U.S. role was quietly stepped up last week after the civilian death toll rose sharply. The number of U.S. personnel was increased from 12 to 20 in the operations center to help vet targets and to perform more precise calculations of bomb blast areas to help avoid civilian casualties.

U.S. reconnaissance drones now send live video feeds of potential targets and of damage after the bombs hit. The Air Force also began daily refueling flights last week to top off Saudi and United Arab Emirates fighter jets in midair, outside Yemen’s borders, so they can quickly return to the war.

You could be forgiven for thinking this a bit rich.  The US has long been waging its own air campaign in Yemen:

The NYT map above is derived from the vital work of the Bureau of Investigative Journalism, and you can find its detailed accounting of drone strikes in Yemen here.  Drone strikes have not been suspended during the new air offensive: earlier this week Al Qaeda in the Arabian Peninsula announced that one of its most prominent spokesmen and clerics, Ibrahim al-Rubeish, had been killed by a US drone strike near the coastal city of al Mukalla.

Readers will know that there has been considerable critical discussion of civilian casualties caused by the programme of targeted killing in Yemen (and elsewhere): so much so that on 23 May 2013 the Obama administration issued a Presidential Policy Guidance [PPG] for the use of force ‘outside the United States and areas of active hostilities’ that supposedly imposed more stringent restrictions on its use of (para)military violence outside ‘hot battlefields’ like Afghanistan.

KLAIDMAN Kill or CaptureThe guidelines affirmed a preference for ‘capture’ over ‘kill’ – ‘The policy of the United States is not to use lethal force when it is feasible to capture a terrorist suspect, because capturing a terrorist offers the best opportunity to gather meaningful intelligence and to mitigate and disrupt terrorist plots’ – and so limited the use of lethal force to situations where ‘capture is not feasible at the time of the operation‘.  That last clause –my emphasis – clearly provides wide latitude for elevating ‘kill’ over capture’, but for a recent, vigorous discussion of the kill/capture debate prompted by the arrest and indictment of Mohanad Mahmoud Al Farekh earlier this month, see David Cole on ‘Targeted killing’ here.

In addition, crucially, the PPG required there to be a ‘near certainty’ that civilians would not be killed or injured during the operation.

Yet even when the guidelines were issued, they were ambiguous.  As Ryan Goodman pointed out, grey zones remained:

The notion of “areas of active hostilities” essentially refers to geographic zones where belligerents engage in sustained fighting. It is a term of art, as far as we can tell, developed by the administration at an unknown date, and not found in international law. In congressional testimony, the administration has stated that it considers Afghanistan an area of active hostilities, and it considers Yemen (despite frequent drone operations in that country) and Somalia outside the area of active hostilities.

These topological contortions did not begin with Obama.  The Bush administration made no secret of its central interest in ‘conducting war in countries we are not at war with‘.

Ryan’s discussion focused on the ambiguous location of Pakistan in this atlas of violence, and in particular the Federally Administered Tribal Areas: were they inside or outside “areas of active hostilities” (or even ‘half-in, half-out’)?  Since then, clearly, Yemen too may have been repositioned by Obama’s cartographers: it’s surely difficult to maintain the pretence that it is now not an ‘area of active hostilities’.

But in between the PPG and the opening of the new air offensive in Yemen, how effective were those restrictions on civilian casualties?  A collaborative investigation carried out by the Open Society Justice Initiative in the United States and the Mwatana Organization for Human Rights in Yemen raises plausible doubts.

Death by Drone (Yemen) (2015)

Their joint report, Death by Drone: civilian harm caused by targeted killing in Yemen, investigates nine US air strikes carried out between May 2012 and April 2014, and is based on interviews with survivors and eyewitnesses, relatives of individuals killed or injured in the attacks, local community leaders, doctors and hospital staff who were involved in the treatment of victims, and Yemeni government officials:

The nine case studies documented in this report provide evidence of 26 civilian deaths and injuries to an additional 13 civilians. This evidence casts doubt on the U.S. and Yemeni governments’ statements about the precision of drone strikes. Yemen’s President Abdu Rabbu Mansour al-Hadi praised U.S. drone strikes in Yemen as having a “zero margin of error” and commented that “the electronic brain’s precision is unmatched by the human brain.” The United States government has similarly emphasized that the precision afforded by drone technology enables the U.S. to kill al-Qaeda terrorists while limiting civilian harm…

[T]his report provides credible evidence that civilians were killed and/or injured in all nine airstrikes, including four which post-date President Obama’s [PPG] speech. To be sure, it is possible—owing to a mistake or an unforeseeable change of circumstances that manifests between the ordering of a strike and its occurrence—for civilians to be killed or injured despite a near-certainty prior to the strike that this would not happen. Nonetheless, the evidence of civilian deaths and injuries in nine cases raises serious concerns about the effective implementation of the “near-certainty” standard.

And in paragraphs that will be dismally familiar to anyone who has read the Stanford/NYU report on Living under drones in the Federally Administered Tribal Areas, the authors add:

The testimonies in this report describe desperately poor communities left to fend for themselves amid the devastation caused by U.S. drone strikes. Mothers and fathers who lost their children in drone strikes speak of inconsolable loss. They speak of their children’s bodies charred beyond recognition. Wives speak of losing their breadwinners, and of young children asking where their fathers have gone. The victims of these strikes say that these strikes will not make the United States or Yemen safer, and will only strengthen support for al-Qaeda.

The report also describes the terrorizing effects of U.S. drones on local populations. In many of the incidents documented, local residents had to live with drones continually flying overhead prior to the strikes and have lived in constant fear of another attack since. Some fled their villages for months after the strike, and lost their source of livelihood in the process. Survivors of the attacks continue to have nightmares of being killed in the next strike. Men go to their farms in fear. Children are afraid to go to school.

Degrees of intimacy

Drone warsNext month Cambridge University Press is publishing a book of essays edited by Peter Bergen and Daniel Rothenberg, Drone wars: transforming conflict, law and policy, due out from Cambridge University Press at the end of the year.  Here’s the blurb:

Over at Foreign Policy you can find an early version of Chapter 6, which is an interview with a drone pilot conducted by Daniel Rothenberg.  There are two passages in the interview that reinforce the sense of the bifurcated world inhabited by drone crews that I described in ‘From a view to a kill’ and ‘Drone geographies’ (DOWNLOADS tab).  On the one side the pilot confirms the inculcation of an intimacy with ground troops, particularly when the platforms are tasked to provide Close Air Support, which is in some degree both reciprocal and verbal:

“Because of the length of time that you’re over any certain area you’re able to engage in lengthy communications with individuals on the ground. You build relationships. Things are a little more personal in an RPA than in an aircraft that’s up for just a few hours. When you’re talking to that twenty year old with the rifle for twenty-plus hours at a time, maybe for weeks, you build a relationship. And with that, there’s an emotional attachment to those individuals.

“You see them on a screen. That can only happen because of the amount of time you’re on station. I have a buddy who was actually able to make contact with his son’s friend over in the AOR [area of responsibility]. If you don’t think that’s going to make you focus, then I don’t know what will.

“Many individuals that have been over there have said, ‘You know, we were really happy to see you show up’; ‘We knew that you were going to keep us from being flanked’; ‘We felt confident in our ability to move this convoy from ‘A’ to ‘B’ because you were there.’ The guy on the ground and the woman on the ground see how effective we are. And it gives them more confidence.”

But when the pilot in Rothenberg’s interview goes on to claim that ‘Targeting with RPAs is very intimate’ and that ‘It is war at a very intimate level’, he reveals on the other side an altogether different sense of intimacy: one that is strictly one-sided, limited to the visual, and which resides in a more abstracted view:

“Flying an RPA, you start to understand people in other countries based on their day-to-day patterns of life. A person wakes up, they do this, they greet their friends this way, etc. You become immersed in their life. You feel like you’re a part of what they’re doing every single day. So, even if you’re not emotionally engaged with those individuals, you become a little bit attached. I’ve learned about Afghan culture this way. You see their interactions. You’re studying them. You see everything.”

The distinction isn’t elaborated, but the claims of ‘immersion’ and becoming ‘part of what they’re doing every day’ are simply astonishing, no?  You can find more on the voyeurism of ‘pattern of life analysis’ and the remarkable conceit that ‘you see everything’ here.

GREGORY Drones and the everywhere war 2014 Homeland insecurities.001

The interview emphasises a different bifurcation, which revolves around the alternation between ‘work’ and ‘home’ when remote operations are conducted from the United States:

“”When you’re doing RPA operations, you’re mentally there, wherever there is. You’re flying the mission. You’re talking to folks on the ground. You’re involved in kinetic strikes. Then you step out the ground control station (GCS) and you’re not there anymore…

“Those are two very, very different worlds. And you’re in and out of those worlds daily. I have to combine those two worlds. Every single day. Multiple times a day. So, I am there and then I am not there and then I am there again. The time between leaving the GCS [Ground Control Station] and, say, having lunch with my wife could be as little as ten minutes. It’s really that fast.”

There’s one final point to sharpen.  In my developing work on militarized vision, and especially the ‘Angry eyes’ presentation/essay,  I’ve tried to widen the focus beyond the strikes carried out by Predators and Reapers to address the role they play in networked operations where the strikes are carried out by conventional strike aircraft.  Here is what Rothenberg’s pilot says about what I’ve called the administration of military violence (where, as David Nally taught me an age ago, ‘administration’ has an appropriately double meaning):

‘”Flying an RPA is more like being a manager than flying a traditional manned aircraft, where a lot of times your focus is on keeping the shiny side up; keeping the wings level, putting the aircraft where it needs to be to accomplish the mission. In the RPA world, you’re managing multiple assets and you’re involved with the other platforms using the information coming off of your aircraft.

“You could use the term ‘orchestrating’; you are helping to orchestrate an operation.”

During this period  769 coalition air strikes were reported: 434 in Syria (the dark columns), including 217 on the besieged border city of Kobane, and 335 in Iraq (the light columns), including 157 on Mosul and the Mosul Dam.

But bear in mind these figures are for all air strikes and do not distinguish between those carried out directly by drones and those carried out by conventional strike aircraft.  As Chris emphasises:

‘Since the start of the bombing campaign, US drones have undertaken both surveillance and strike missions in Iraq and Syria but military spokespeople have refused to give details about which aircraft are undertaking which strikes repeatedly using the formula “US military forces used attack, fighter, bomber and remotely-piloted aircraft to conduct airstrikes.”’

Although the USAF has used a mix of MQ-1 (Predator) and MQ-9 (Reaper) drones, F-15E, F-16, F/A-18 and F-22 fighters, B-1 bombers, AC-130 gunships and AH-64 Apache helicopters in these operations, it seems likely that its capacity to use remote platforms to provide intelligence, surveillance and reconnaissance is limited by its continuing commitments in Afghanistan (though Britain’s Royal Air Force has now deployed its Reapers for operations in both Iraq and Syria).

IS (Islamic State) claims to have its own drones too.  In February it released video of its aerial surveillance of Fallujah in Iraq, taken from a DJI Phantom FC40 quadcopter, in August it released video of Taqba air base in Syria taken from the same platform, tagged as ‘a drone of the Islamic State army’, and in September a propaganda video featuring hostage John Cantile showed similar footage of Kobane (below).

These image streams are all from commercial surveillance drones, but in September the Iranian news agency Fars reported that Hezbollah had launched an air strike from Lebanon against a command centre of the al-Nursra Front outside Arsal in Syria using an armed (obviously Iranian) drone.

The details of both the state and non-state air strikes remain murky, but I doubt that much ‘intimacy’ is claimed for any of them.

Gaza, stripped again

As Craig Jones notes over at War, Law and Space, the renewed fighting between Hamas and the IDF is all too familiar; so too is the cartography.

In November 2012, the New York Times published two maps – one showing Israeli cities ‘taking enemy fire’ and the other showing the site of Israeli leaflet drops on Gaza (see my discussion here).

This time round, the only maps available until today have shown the putative range of Hamas’s rockets and the strikes that have taken place in Israel: Gaza might just as well have been a blank space marked ‘here be monsters’ (which is, of course, exactly how the Netanyahu administration wants us to see it).

This evening, Britain’s Telegraph published this map:

What the latest Israeli assault shows once again, however, is that the key on the left-hand map is misleading.  To juxtapose ‘Israeli-controlled’ with ‘Palestinian territories’ is like juxtaposing ‘fruit’ to ‘apples’.  So many domains of life – and death – in the Palestinian territories, in both the occupied West Bank and Gaza, remain firmly under Israeli control.
